Why Save Barnegat Bay Took Legal Action
Save Barnegat Bay filed a lawsuit because the Little Egg Harbor Planning Board
approved a large Lennar development before the critical environmental and planning questions were answered, and in ways that conflict with New Jersey land-use-law.
What the Development is
415-unit-age-restricted development
Approximately 146 acres
Located along Route 9 and Center Street
Includes extensive clearing, new roads, and major stormwater systems
Drains into Barnegat Bay Category One waters, which receive the highest level of protection under state law
The Core Problems
The zoning does not match the Township Master Plan
The Environmental reviews were incomplete
Stormwater and flooding risks were incomplete
Public process and fairness broke down
What the Lawsuit Asks the Court to Do
Invalidate zoning provisions that are inconsistent with the Master Plan
Vacate the Planning Board Approval
Require the Township and developer to follow the law before project moves forward
Ensure open space, flooding, and environmental protections — not theoretical
